    Planning appeals: Expert service to Lancashire councils

    The planning team at RSK company ADAS is instructed by 16 local planning authorities (LPA) in the north west of the UK to provide expert advice. We assist their planning officers in determining applications. The service provision also includes planning appeal casework, defending the decisions of the LPA for both written representations and informal appeal hearings.

    For example, the team successfully defended the decision of Chorley Borough Council to refuse planning permission for a single farm-worker’s dwelling. The main issues of the appeal were whether the proposed development would be an inappropriate development in the green belt, the effect of the proposed development on the openness of the green belt, and the effect of the proposed development on the character and appearance of the appeal site and surrounding area. The last issue was if the proposal was an inappropriate development in the green belt; that is, whether the harm by reason of inappropriateness and any other harm were so clearly outweighed by other considerations that they amounted to the very special circumstances necessary to justify the development.

    The ADAS team assisted the council in preparing the appeal documentation and the statement of case, and attended the informal hearing.

    At the informal hearing, the ADAS team defended their professional advice, which was provided to the council in front of the planning inspector, and further challenged the applicant and their agent. The case presented by the team examined the actual agricultural need for the single farm dwelling on a site that already had ample accommodation to serve the functional requirement of the farm unit. The inspector, in their decision notice, stated, “I am not satisfied that it has been demonstrated that there is an essential need for a further rural worker to live permanently on the site.”

    The appeal was dismissed and the refusal upheld. This was the fourth such hearing that was defended successfully by ADAS, which demonstrates the credibility of our expert advice.
